Rule 8 - MOTIONS TO STAY IN CRIMINAL APPEALS

Contents of Motion. If the motion to stay pertains to a criminal conviction, the moving party's memorandum in support shall also contain the following:

(1) a statement of the specific offenses of which the appellant was found guilty;
(2) a general statement of the facts upon which the conviction was based;
(3) a brief statement of any claimed error and why there is a reasonable chance of success on appeal;
(4) a statement of all criminal charges which are presently pending against the appellant in other actions;
(5) a statement of the appellant's prior convictions;
(6) a statement of appellant's ties to the local community, including any family ties and any employment; and
(7) a statement of the bail, if any, the appellant was required to post while the case was pending before the trial court. To the extent that the moving party fails to address any of the foregoing, or if the opposing party contests the truthfulness of the information provided by the moving party, the opposing party should also address the foregoing in its response.
