Rule 5 - Appeals By Leave Of Court In Criminal Cases(A)Motion by Defendant in Delayed Appeal. When a defendant appeals pursuant to App.R. 5(A), the clerk of court shall serve a copy upon the prosecuting attorney. The prosecuting attorney shall be afforded ten days to respond in writing as to whether the defendant is entitled to a delayed appeal.
