No juror may testify as a witness before other jurors in the same jury venire.

The amendment made by supreme court order dated April 20, 2017, effective July 1, 2017, made stylistic changes to the rule.

New Hampshire Rule of Evidence 606 differs from Federal Rule of Evidence 606. Federal Rule of Evidence 606 includes a subsection (a) and a subsection (b). The language of subsection (a) of the federal rule is similar, but not identical, to the language set forth in New Hampshire Rule of Evidence 606.

The language of New Hampshire Rule of Evidence 606 recognizes the unique nature of New Hampshire jury practice. New Hampshire Rule of Evidence 606 does not include the language of Federal Rule of Evidence 606(b) because the language of the Federal Rule appears to be more restrictive than New Hampshire law. The Committee saw no reason to restrict the judge's discretion.
