If the appellate court affirms or modifies the judgment of the trial court, it shall direct the sentence pronounced to be executed and the same shall be executed accordingly. If the judgment is reversed or modified, the appellate court shall direct a new trial or direct that the defendant be absolutely discharged or direct the trial court concerning further proceedings to be taken. If the state has taken the appeal, the appellate court shall affirm the judgment or ruling of the court below or reverse or modify the same and direct the trial court concerning further proceedings to be taken.
