No person shall, for any felony, be proceeded against without indictment, except by means of an information where a defendant represented by counsel waives indictment by sworn statement in writing.
Miss. R. Crim. P. 14.5
Comment
Rule 14.5 is consistent with Article 3, Section 27 of the Mississippi Constitution. A properly executed waiver of indictment vests the trial court with full authority to dispose of the felony offense for which indictment was waived. See Williams v. State, 708 So. 2d 1358, 1364 (Miss. 1998).
