As required by G.L. c. 231, § 108, the presiding justice of each Appellate Division district shall from time to time designate those Appellate Division justices who shall act on appeals in that district and direct the times and places of sittings.
Mass. Dist. Ct. & Mun. Ct. R. 31
Commentary
This rule is totally different from Mass.R.A.P. 31. The latter deals with the duties of the appellate court clerk; there is no clerk, as such, In the District Court Appellate Division. Instead, this rule addresses the statutory duty of the Presiding Justice of each of the three Appellate Division districts to appoint the panels to hear cams and to schedule those hearings.
