Rule 19-721 - Petition for Disciplinary or Remedial Action(a)Commencement of Action.(1)Upon Approval or Direction of the Commission. Upon approval or direction of the Commission, Bar Counsel, on behalf of the Commission, shall file a Petition for Disciplinary or Remedial Action in the Court of Appeals.(2)Conviction of Crime; Reciprocal Action. If authorized by Rule 19-737 or 19-738, Bar Counsel, on behalf of the Commission, may file a Petition for Disciplinary or Remedial Action in the Supreme Court without prior approval of the Commission. On review, the Commission may direct the withdrawal of a petition filed pursuant to this subsection, in which event, Bar Counsel shall withdraw the petition.Cross reference: See Rule 19-707(b)(10) concerning confidentiality of a petition to place an incapacitated attorney on inactive status.
(b)Form of Petition. The Commission shall be the petitioner. The attorney shall be the respondent. The petition shall be sufficiently clear and specific to inform the attorney of any professional misconduct charged and the basis of any allegation that the attorney is incapacitated and should be transferred to disability inactive status. This Rule is derived from former Rule 16-751(2016).
