Rule 4 - Judicial Budgetary Control Board Rule 24:38.1 (applicable to La. R.S. 24:38).
(a) Membership; Term; Expenses; Staff and Others. There is hereby created the Judicial Budgetary Control Board to be composed of thirteen members. The thirteen members shall be: the chief justice of the supreme court; an associate justice of the supreme court designated by the chief justice, who shall be the chairman; the chief judge of each court of appeal or his designee; a district judge selected by the Louisiana District Judges Association; a judge of the criminal district court, Parish of Orleans two district judges, and a judge of a separate juvenile or family court, each appointed by the chief justice of the supreme court; and the judicial administrator of the supreme court. Members shall serve for three-year terms and may serve successive terms. The board shall meet on call of the chairman as necessary in the performance of its duties hereinafter enumerated. Members of the board shall serve without. compensation therefor but shall be entitled to reimbursement for necessary and reasonable travel expenses incurred in the performance of their duties. The office of the judicial administrator of the supreme court shall provide staff assistance to the board; however, the board may from time to time employ or contract with such professional or other qualified consultant or consultants as may be deemed by a majority of the board to be necessary or desirable. Travel and other expenses of the board shall be paid from finds appropriated to the judiciary.
(b) Rules and Regulations; Establishment; Scope. The board shall, on or before November 30, 1977, establish rules and regulations, subject to formal approval by the supreme court, to govern the expenditure of all funds appropriated by the legislature to the judiciary; to each court, council, commission or board, whether created by rule, statute or otherwise; to the Law Library of Louisiana; to the Louisiana Judicial College and to any and all judicial officers, employees and service agencies. Such rules and regulations, to be effective January 1, 1978, shall provide procedures for expenditures and disbursement of funds by any such court, council, commission, committee, board, agency, or other body or persons and for the administration, supervision and approval thereof and may include, but shall not necessarily be limited to, rules and regulations, and in conflict with law, with respect to any of the following: (i) Preparation and submission of budgetary requests;(ii) Review of budgetary requests;(iii) Approval of budgetary requests;(iv) Preparation and submission of financial statements and reports and requirements as to the contents thereof;(v) Uniform accounting systems and procedures;(vi) Authorization and approval for expenditures;(vii) Procedures for withdrawal of funds for expenditures;(viii) Procedures for interpretation of items in appropriation laws;(ix) Authorization for transfer of funds;(xi) Purchasing procedures, including advertisement and letting of bids;(xii) approval of contracts;(xiii) Travel and office expenses;(xiv) Use of facsimile signatures; and(xv) Payment of compensation for regular and overtime work.(c) Rules and Regulations; Compliance; Changes; Report. Effective January 1, 1978, each court, council, commission, board, agency, other body or persons designated in subsection (b) of this section shall be subject to and comply with such rules and regulations in expending or otherwise disbursing funds appropriated to them. The board may from time to time amend, repeal, add or otherwise alter such rules and regulations subject to the approval of the Louisiana Supreme Court. The board shall have authority to implement and carry out all such rules and regulations after approval thereof. In addition, the board shall report any transfer of funds to the state treasurer upon final approval thereof.(d) Judicial Branch Budget Request. Prior to each session of the legislature, the board shall present a proposed unified budget request for the judicial branch to the Louisiana Supreme Court for its approval. The Louisiana Supreme Court, acting under its inherent and administrative authority, Louisiana Constitution Article V, Sections 1, 5, may present the unified budget request on behalf of the judicial branch to the legislature.
