Rule RCr 4.20 - Use of uniform schedule of bail(1) The defendant may execute a bail bond in accordance with the uniform schedule of bail (Appendix A) for designated nonviolent Class D felonies, misdemeanors and violations without appearing before a judge. If a defendant chooses to execute a bail bond in accordance with the schedule without appearing before a judge and proceeds to do so, that defendant waives his or her statutory right to be considered for other authorized methods of pre-trial release. Before said waiver is effective, the defendant must be informed of his or her right to appear before a judge without unnecessary delay, and to be considered for release on personal recognizance. (2) In the exercise of its reasonable discretion the court may refuse to set bail in the amount prescribed by Appendix A, but must record written reasons for the deviation. (3) Each court may by local rule establish a uniform schedule of bail for violations of ordinances of cities and counties over which it has jurisdiction; provided, however, that when the ordinance is punishable by a fine only, the amount of the bond set shall not exceed the amount of the maximum penalty and costs.
