Rule 3.518 - Diversion

Any respondent charged with an offense which would constitute a misdemeanor or a non-erson felony, and who had no prior adjudication within the juvenile system and no prior diversion may apply for diversion through the District Attorney's office subject to approval by the court. Diversion shall be monitored by Court Services subject to the standard terms and conditions of probation. If diversion is granted and successfully completed, the complaint will be dismissed. If diversion is denied or the respondent fails to successfully complete the diversion agreement, the complaint shall be subject to resolution in the ordinary course of practice or procedures within the Kansas Juvenile Justice Code.
