Section 12 - Trials and HearingsA lawyer should act in trial and hearings in a manner that promotes a positive image of the profession, assists the court in properly reviewing the case, and displays appropriate respect for the justice system.
Specifically, a lawyer who manifests professional courtesy and civility:
(a) Is punctual and prepared for all court appearances, including remote hearings where a lawyer shall appear with the video camera on and be clearly visible, unless otherwise excused by the court.(b) Dresses in appropriate courtroom attire, unless exceptional circumstances dictate otherwise for all court appearances, including remote hearings.(c) Engages in appropriate conduct for all court appearances, including remote hearings, and deals with parties, counsel, witnesses, jurors or prospective jurors, court personnel and the judge with courtesy and respect.(d) Makes objections during a trial or hearing for legitimate and good faith reasons and does not make such objections only for the purpose of harassment or delay. (e) Honors requests made by opposing counsel during trial that do not prejudice the rights of the lawyer's client or sacrifice tactical advantage.(f) While appearing before the court, addresses all arguments, objections and requests to the court, rather than directly to opposing counsel.Amended effective 10/4/2004; amended September 7, 2017, effective 1/1/2018; amended August 22, 2023, effective 1/1/2024.
