Rule 8.4 - Transfer of Delinquency Case from Superior Court(a)Prior to Indictment. Whenever the prosecution of delinquency charges is initiated in the juvenile court by the district attorney pursuant to the discretion provided in O.C.G.A. § 15-11-560(d), the district attorney shall commence the case in the juvenile court by filing with the clerk of the juvenile court a fully completed complaint form.(b)After Indictment. Whenever the prosecution of delinquency charges is initiated in the juvenile court by order of the superior court, the clerk of superior court shall within three working days of the entry of the order, file with the clerk of the juvenile court certified copies of the order of transfer, the indictment, and all motions, orders and other pleadings and documents contained in the file. The clerk of the juvenile court shall cause a fully completed complaint form to be filed within 24 hours of receipt of the documents from the clerk of the superior court as outlined in O.C.G.A. § 15-11-560(e) and (f).Amended May 2, 2019, effective July 1, 2019.
