Rule 17 - Dismissal of Actions(a) VOLUNTARY DISMISSAL.(1)In General. The petitioner may dismiss an action without a court order by filing a notice of dismissal. The notice must be served on all parties in accordance with Rule 4.(2)Effect. Unless the notice states otherwise, the dismissal is without prejudice.(b) INVOLUNTARY DISMISSAL.(1)In General. If the petitioner fails to prosecute or to comply with these rules or a court order, any party may move to dismiss the petition, or the court may, on its own initiative, enter an order dismissing the petition.(2)Effect. Any order of dismissal entered by the court under this rule does not take effect until 14 days after the date on which it is docketed and must be vacated on the granting of a motion filed by the petitioner within the 14-day period showing good cause why the case should not be dismissed.
