Rule 2 - Applicability of Rules

Section 2.1 Title

These rules shall be known as the Connecticut Probate Court Rules of Procedure.

Section 2.2 Applicability

(a) These rules govern practice and procedure in the Connecticut Probate Courts and are mandatory in the courts.

(b) The rules do not apply to appeals from probate in the Superior Court, matters transferred from a Probate Court to the Superior Court or any other probate matter in the Superior Court.

(c) If a rule conflicts with statute, the statute governs.

Section 2.3 Purpose

The purpose of these rules is to facilitate the efficient conduct of business in the Probate Courts and to advance justice. The court may interpret these rules liberally if strict adherence will cause injustice.
