The purpose of the commission is to administer the judicial discipline and incapacity system established by the constitution. The commission has jurisdiction over judges and former judges concerning allegations of misconduct occurring prior to or during service as a judge and allegations of incapacity during service as a judge.

RULES GOVERNING
<Proceedings commenced prior to the January 1, 2002 effective date of these new rules shall continue to be governed by the rules effective prior to the effective date until the closure of the matter.>
HISTORICAL NOTES
The former rule, adopted May 24, 1990, effective July 1, 1990, amended March 27, 1995, effective June 1, 1995, was abrogated by Order dated October 11, 2001, effective December 31, 2001. Because the former rule has continuing effect for actions begun prior to the date of repeal, the text of the rule is set out below.
"Rule 2. Administration
"(a) Staff. The commission may employ an executive director and such other staff as it deems necessary to assist the commission in performing its duties.
"(b) Duties of Executive Director. The duties and responsibilities of the commission's executive director include the authority to:
"(1) Consider information from any source and receive allegations and complaints;
"(2) Make preliminary evaluations for the purpose of screening complaints as provided in these rules;
"(3) Conduct commensurate informal or preliminary investigations;
"(4) Maintain and preserve the commission's records, including all complaints, files and written dispositions;
"(5) Maintain statistics concerning the operation of the commission and make them available to the commission and to the supreme court.
"(6) In cooperation with the administrative director of the courts, prepare the commission's budgets for approval by the commission, and administer its funds;
"(7) Employ and supervise other members of the commission's staff;
"(8) Prepare reports of the commission's activities;
"(9) Accept service on behalf of the commission of all pleadings or judicial process; and
"(10) Carry out such other activities as directed by the commission for the accomplishment of its duties.
"(c) Disciplinary Counsel and Investigators. The commission or its executive director may employ disciplinary counsel and investigators to confer with and advise the commission, to conduct investigations, to represent the commission in formal proceedings or in hearings before the supreme court, or to perform any other services needed to resolve an investigation or any matter pending before the commission.
"(d) Office and Hours. The commission shall establish a permanent office in a building open to the public, provided, however, that the office of the executive director may constitute the office of the commission. The office shall be open and staffed upon announced days and at specified hours.
"(e) Rules and Policies. Rules of procedure shall be submitted to the supreme court for approval. The commission may adopt administrative policies and forms that do not conflict with the rules approved by the court."
