Rule 12.4 - Who May be Present During Grand Jury Sessions(a)General. Only the following individuals may be present during grand jury sessions: (1) the witness under examination;(2) counsel for a witness if the witness is a person under investigation by the grand jury;(3) a law enforcement officer or detention officer accompanying an in-custody witness;(4) prosecutors authorized to present evidence to the grand jury;(5) a certified reporter; and(6) an interpreter, if any.(b)Deliberations. Only grand jurors may be present during their deliberation and voting.Added August 31, 2017, effective 1/1/2018; amended on an emergency basis, effective 9/30/2021; adopted on a permanent basis effective 1/1/2022.
