Rule 403 - Exclusion of Relevant Evidence on Grounds of Prejudice, Confusion, or Waste of Time

Although relevant, evidence may be excluded if its probative value is outweighed by the danger of unfair prejudice, confusion of the issues, or misleading the jury, or by considerations of undue delay, waste of time, or needless presentation of cumulative evidence.

Chapter 44 SLA 2009 (HB 102), effective January 1, 2010, enacted changes relating to the Uniform Commercial Code. According to section 9 of the Act, AS 45.01.303(g) has the effect of amending Alaska Rules of Evidence Rule 403 by requiring the exclusion of certain relevant evidence relating to usage of trade unless certain conditions are met.
