(a) Following hearing, the Presiding Officer shall make a recommended decision to the Board. The recommended decision shall include findings of fact and conclusions of law on all material issues in the contested case.
(b) Such recommended decision shall be in writing, filed with the System and served upon all parties to the contested case.
(c) Within ten (10) days of the date of the Presiding Officer's recommended decision, any party may file a motion for rehearing for any of the reasons identified in Rule 59(a) of the Wyoming Rules of Civil Procedure. The Presiding Officer shall issue a written order in response to the motion.
(d) The Board shall render a final decision within a reasonable time upon receipt of the Presiding Officer's recommended decision.
(e) The decision of the Board upon hearing is a final administrative decision and is subject to judicial review in accordance with the Wyoming Administrative Procedure Act. Unless otherwise provided by law, any party aggrieved or adversely affected by a final decision in a contested case is entitled to judicial review in the appropriate district court pursuant to W.S. § 16-3-114.
(f) In case of an appeal to the district court, the party appealing shall secure and file a transcript of the testimony and other evidence offered at the hearing which transcript must be verified by the oath of the reporter who transcribed the testimony as a true and correct transcript of the testimony and other evidence submitted at the hearing.
