(a) The Director or his/her designee shall administer this program according to the rules of this program, and shall determine whether the applicant is eligible under these rules;
(b) The Department shall provide the applicant written notice of its determination;
(c) Documentation of the action taken and the reasons for the action shall be placed in the applicant's file;
(d) The Director or his/her designee may request documentation to corroborate any information requested in the application;
(e) The funds appropriated by the legislature will be allocated by the Department for loans to physicians or contracting entities for the purpose identified under m the Act and pursuant to these rules;
(f) The Director or his/her designee shall be responsible for servicing the loans for those physicians or contracting entities;
(g) The denial of assistance is not an adverse action, and an applicant who does not receive assistance has no right to reconsideration pursuant to Chapter 3, Rules for Medicaid Administrative Fair Hearings of the Wyoming Medicaid rules or a contested case pursuant fo Chapter I Rules for Medicaid Administrative Fair Hearings of the Wyoming Medicaid rules, or any other provision of the Departments rules or the Wyoming Administrative Procedure Act.
