The definitions set forth in the Wyoming Administrative Procedures Act W.S. 16-3-101, et seq., are incorporated by reference and, for the purposes of a contested case hearing the following definitions apply.
(a) "Contested Case" means a proceeding involving the denial, revocation, restriction or suspension of a license or certification during which legal rights, duties or privileges of a Contestant are required by law to be determined by the Department after an opportunity for hearing. The hearing shall be conducted in accordance with the Wyoming Administrative Procedures Act, W.S. W.S. W.S. 16-3-101, et seq.;
(b) "Contestant" means the person who requests the hearing;
(c) "Department" means the Wyoming Department of Health, its agent, designee or successor;
(d) "Discovery" means pre-hearing procedures used to obtain information from the adverse party;
(e) "Hearing" means a contested case hearing before a hearing officer;
(f) "Hearing Officer" means the individual or individuals designated by the Department to serve as the presiding officer(s) at a hearing held under this Chapter of these rules;
(g) "Respondent" means the Department;
(h) "Wyoming Administrative Procedures Act" or "WAPA" means W.S. W.S. W.S. 16-3-101, et seq.; and
(i) "Wyoming Rules of Civil Procedure" or "WRCP" means the rules governing procedure in all courts of record in the State of Wyoming, in all actions, suits or proceedings of a civil nature, Rule 1 of the Wyoming Rules of Civil Procedure.
