The Contestant may make a written request to the Department for a hearing in a contested case.
(a) The request shall contain at least:
(b) The request shall be directed to the Department within 10 days of the knowledge of the action or proposal of action to be contested.
(c) The contestant initiating a hearing shall provide the other party with a copy of the request at the same time that the request is filed with the Director.
(d) The Director shall inform the contestant of any low cost or free legal services available, including the phone number and address of Protection and Advocacy System, Inc.
(e) Before requesting a hearing, both parties shall have made efforts to exhaust local administrative remedies.
(f) The Director shall take steps to ensure that within 45 days after the receipt of the request for hearing, the hearing is commenced and completed, including any mediation conducted pursuant to Section 6, and final administrative decision is rendered, unless a continuance has been granted pursuant to Section 6 or Section 9 subsection f.
(g) Services provided to the contestant at the initiation of the request for hearing shall not be changed during the proceedings, unless explicitly agreed to by both parties, or unless necessary to protect the health and safety of the contestant.
