It is the philosophy of the Program Division to develop reasonable and enforceable rules for the placement of individuals with disabilities in community settings such as assisted living facilities in lieu of unnecessary institutionalization. This philosophy is mandated in the Supreme Court ruling on Olmstead v. L.C.
These rules are designed not only to support the philosophy of community placement but to also protect the health, welfare, and safety of residents in assisted living facilities.
