Section NR 809.02 - Departmental justification(1) Where the department exercises discretion allowed under this chapter to require a water supplier for a public water system to perform construction, repairs, monitoring or other activities which would necessitate expenditure of resources, the department shall explain in writing the reasons for the requirements.(2) A decision by the department to grant a waiver shall be made in writing and shall set forth the basis for the determination. The waiver determination may be initiated by the department or upon an application by the water supplier for a public water system.Wis. Admin. Code Department of Natural Resources § NR 809.02
