The purpose of this subchapter is to establish procedures for the determination by the department of alternative effluent limitations for temperature as authorized under s. 283.17, Stats. An alternative effluent limitation for temperature may be established by the department if the owner or operator of a point source demonstrates to the department that a proposed effluent limitation established under subch. V is more stringent than necessary to assure the protection and propagation of a balanced indigenous population of shellfish, fish and wildlife in and on the body of water into which the discharge is made.
