1.1. Scope. -- W. Va. Code ''31-20-5 and 25-5-10, as amended, mandates that the West Virginia regional jail and correctional facility authority promulgate rules and regulations for site selection and the public hearings required to be held prior to beginning construction, acquisition or renovation of any new facility or any existing facility not then used as a jail for use as a regional jail or prison facility. Rules for notice and other procedures of said public hearings shall be as similar as practicable to those hearings conducted regarding the construction of bridges by the West Virginia Department of Highways.1.2.
