Section 91-2-9 - Physical Inspection of Serial Number of All Motor Vehicles Being Registered In This State From Any Other Jurisdiction

Effective the first day of July, Nineteen Hundred and Sixty-nine, the Department of Motor Vehicles will not issue a certificate of title for any motor vehicle originating from any jurisdiction or possession of the United States or any foreign jurisdiction including motor vehicles owned by members of Armed Forces that are registered in a foreign country until such vehicle is physically inspected to determine the correct serial number of the vehicle.

The following state and city agencies are authorized to make such inspections and to execute the "Serial Number Inspection Certificate", Form DMV 1-B.

Members of the West Virginia Department of Public Safety.

All West Virginia Motor Vehicles Inspection Stations, except those designated as fleet stations, that have been authorized and designated as an Official Inspection Station by the Department of Public Safety.

In the event the vehicle to be registered in West Virginia is located in another jurisdiction or at the factory, and the owner cannot move the vehicle until the West Virginia registration is received, the department would accept the serial number inspection certification properly executed by a law enforcement officer from the state in which the vehicle is located.

Form DMV 1-B, "Serial Number Inspection Certificate", should be properly executed in every detail by any member of the agency authorized to make such inspections. The form makes it possible for the officer or inspector to make the serial number inspection of the vehicle without the other jurisdiction's certificate of title or other proof of ownership. When the application for West Virginia Certificate of Title is submitted to the Department of Motor Vehicles with the out-of-state certificate of title or other source document and the serial number inspection certification, it shall be the responsibility of the Department of Motor Vehicles to determine if the source document is valid and acceptable and if the serial number certification corresponds with the serial number shown on the source document.

DMV-1-B SERIAL NUMBER INSPECTION CERTIFICATION

This is to certify that I have this day made physical examination of the vehicle described on the attached Application for West Virginia Certificate of Title and do hereby certify that the actual Serial Number of the Vehicle is

This form must be executed with a typewriter or printed with ink. Any alterations or erasures will void this certificate.

In addition to motor vehicles registered in other jurisdictions, the serial number inspection certification would be required on applications for certificate of title in any of the miscellaneous categories outlined herein:

(1) New motor vehicles purchased in another jurisdiction and the owner has a Manufacturer's Certificate or State of Origin in his name or properly assigned to him by a dealer as proof of ownership.
(2) Any motor vehicle registered in another jurisdiction that is being repossessed by the lien holder in this State. If the lien holder does not have possession of the certificate of title issued by the other jurisdiction, the inspection should be made from the serial number shown in the description of the vehicle on Form Number MV-129-TR, an affidavit that is required for all vehicles being repossessed in this State.
(3) Motor vehicles sold by order of a court, if the purchaser does not have the certificate of title for the vehicle, the inspection should be made from the Court Transcript of Docket outlining the sale of the vehicle. The transcript must show a description of the vehicle including the serial number.
(4) Application for certificate of title for vehicles that have been abandoned in accordance with the provisions of Chapter Seventeen A, Article Four, Section Twelve of the Motor Vehicle Code. The inspection should be made from the contents of the affidavit that the applicant is required to submit by statute.
(5) Vehicles sold at public auction to satisfy a Mechanic's Lien as provided in Chapter Thirty-eight of the West Virginia Code. The inspection should be made from the contents of the Department of Motor Vehicles forms Sixty and Sixty-A which are required to secure a certificate of title to satisfy a Mechanic's Lien.
(6) Any other type of application for a certificate of title that does not involve a West Virginia Certificate of Title.
(7) No inspection is required for vehicles titled in this State or for new motor vehicles sold by a registered West Virginia dealer that is authorized to sell new motor vehicles in this State.

Additional copies of Form DMV-1-B can be obtained from the Department of Motor Vehicles on written request by any inspection station authorized to make and execute serial number certifications.
