Section 78-19-21 - Administrative and Judicial Review21.1. In accordance with the provisions of W. Va. Code § 49-2-105, a family child care home may seek an administrative review of a decision made by the secretary by requesting a hearing within 30 days of receiving the notice of the decision.21.2. A family child care home may also seek immediate relief from the decision of the secretary by a showing of good cause made by verified petition to the Circuit Court of Kanawha County or the circuit court of the county where the home is located.W.
