All research, studies, and investigations conducted in mental health facilities to which this rule is applicable, which use facility staff, records or patients shall be approved in writing in advance by the Department of Health and Human Resources and the Institutional Review Board. This advance approval is required whether the research, study or investigation is conducted by Department of Health and Human Resources staff or by others. The federal regulations Protection of Human Subjects, 45 C.F.R. Part 46, are hereby adopted by reference, and all research, studies, or investigations conducted in mental health facilities shall comply with this rule.
