Section 61-30-3 - Regulatory authority3.1. The Department has the authority to deny product registrations it deems are potentially hazardous and/or pose a threat to consumer safety.3.2. Rules governing the requirements for licensing, cultivating, testing, processing, supervision, production, and sale of raw hemp in West Virginia are found in 61 C.S.R. 29.3.3. The rules provided in this rule are in addition to any requirements imposed by the United States Department of Agriculture, the federal Food and Drug Administration, or any other federal agency with regulatory authority over hemp products.
