Section 58-35-2 - DefinitionsFor the purposes of this part the following terms, respectively, shall mean:
2.1. Director. The Director of the Division of Natural Resources, or his or her designee;2.2. Manual. The West Virginia Erosion and Sediment Control Field Manual of the West Virginia Office of Oil and Gas, Department of Environmental Protection, as authorized by W. Va. Code § 22-6-6(d).2.3. Operations. All functions, work, and activities in connection with drilling, exploration, development, or processing of oil or gas resources and all uses reasonably incident thereto, including roads and other means of access on lands subject to the rules in this series.2.4. Operator. A person conducting or proposing to conduct operations.2.5. Person. Any individual, partnership, corporation, association, or other legal entity.2.6. Plan. The erosion and sediment control plan submitted with an operator's permit application to the West Virginia Office of Oil and Gas, West Virginia Department of Environmental Protection, as part of the permitting process.
