Section 47-35-6 - STANDARDS APPLICABLE TO TRANSPORTERS OF HAZARDOUS WASTE6.1. 40 CFR Part 263. -- The provisions of 40 CFR part 263 are hereby adopted and incorporated by reference insofar as said regulations relate to the transportation of hazardous waste by air and water.6.2. Note. -- The use of railroads for the transportation of hazardous waste is regulated by the West Virginia public service commission rules, "Rules and Regulations Governing the Transportation of Hazardous Waste by Rail", 150 CSR 11. The use of the state. highways for the transportation of hazardous waste is regulated under the West Virginia division of highways, "Transportation of Hazardous Waste upon the Roads and Highways", 157 CSR 7.
