Section 36-35-3 - Auger-Type Continuous Mining Machines3.1. After the effective date of these regulations, all auger-type continuous miners used in a working place in a coal mine, which utilize manually-set jacks to advance the mining machine, shall be equipped with jacks which can be remotely set without proceeding in by roof support. This requirement shall be implemented according to the following schedule: New machines purchased

3.2. A waiver may be granted by the Director where it has been demonstrated by the operator and determined during an investigation by an authorized representative of the Director that the use of a remotely set jack would cause a greater hazard than the method presently being employed or proposed by the operator to advance the machine.
