Section 15-5-3 - Wholesale Drug Distributor and Third-Party Logistics Provider Licensing and Manufacturer Permit Requirements3.1. Every wholesale distributor, wherever located, who engages in the wholesale distribution of drugs into, out of, or within the state must be licensed by the West Virginia Board of Pharmacy (hereinafter, the "Board") in accordance with the laws and regulations of this state before engaging in the wholesale distribution of prescription drugs. Every wholesale distributor, wherever located, who engages in the wholesale distribution of drugs into, out of, or within the state shall report discipline from any jurisdiction within thirty days of the entry of the final order. 3.2 Any person operating as a manufacturer of prescription drugs must obtain a manufacturing permit issued by the Board in accordance with the laws and regulations of this state before engaging in manufacturing of prescription drugs in this state.3.3 Notwithstanding any other provision to the contrary, each entity that meets the definition of a third-party logistics provider shall obtain a license as a third-party logistics provider and is not required to obtain a license as a wholesale distributor if the entity never assumes an ownership interest in the product it handles.
