Section 15-1-7 - Refilling Prescription Orders7.1. A pharmacist may not refill any prescription order containing a drug if the label of the original container bears the statement, "CAUTION: Federal Law Prohibits Dispensing Without Prescription", or "RX Only", unless the practitioner has authorized the refill by written notation on the original prescription order. Subsequent refill authorization shall be treated as a new prescription order.7.2. If a prescription order is refillable, the date of the refill and the handwritten initials of the pharmacist shall be recorded upon the original written prescription order; if an Automated Data Processing System is used to document the refill, such documentation shall be completed in accordance with West Virginia Title 15 Code of State Rules Series 4.7.3. No prescription order may be refilled after twelve (12) months from the date of issuance by the practitioner.7.4. The refilling of prescription orders for controlled substances is limited by provisions of the Uniform Controlled Substances Act, W. Va. Code § 60A-3-308.
