Section 146-5-4 - Declaration of Intent to Participate4.1. Before attempting to qualify to receive public campaign financing funds, a candidate must file with the Secretary a declaration of intent on a form provided by the SEC.4.2. The time limit for filing the declaration is4.3. The filing date of the declaration is the date of the postmark if mailed, and is the date delivered to the Secretary if hand-delivered or if delivered by facsimile or by electronic means.4.4. The declaration shall contain a statement that the candidate is eligible to be placed on the ballot and, if elected, to hold the office sought.4.5. The declaration shall contain a statement that the candidate has, and will continue to, comply with all requirements of article 12, chapter 3, of the West Virginia Code, including contributions and expenditure restrictions.4.6. A candidate may not accept qualifying contributions before filing the declaration of intent.
