Section 67-25-040 - Workforce development system-Requirements of department(1) Under WIOA, the department is identified as a required partner within the one-stop delivery system.(2)(a) Access to the department's programs and activities is required through the state's comprehensive one-stop centers.(b) Access to the department's programs and activities may mean:(i) Having a program staff physically present at the one-stop center;(ii) Having a staff member from a different partner program physically present at the one-stop center appropriately trained to provide information to customers about the programs, services, and activities available through the department; or(iii) Making available a "direct linkage" through technology to program staff who can provide meaningful information or services:(A) A "direct linkage" means providing direct connection at the one-stop center, within a reasonable time, by phone or through a real-time web-based communication to a program staff member who can provide program information and/or services to the customer;(B) A "direct linkage" cannot exclusively be providing a phone number or computer web site or providing information, pamphlets or materials.(3) The department must use a portion of funds (to the extent consistent with WIOA and with federal cost principles in 2 C.F.R. Parts 200 and 3474, requiring, among other things, that costs are allowable, reasonable, necessary, allocable, and proportionally beneficial to the department) to:(a) Provide applicable career services; and(b) Work collaboratively with the state and local workforce development boards to establish and maintain the one-stop delivery system. This includes jointly funding the one-stop infrastructure costs (as defined in 34 C.F.R. section 361.700 ) through partner contributions that are based upon: (i) A reasonable cost allocation methodology by which infrastructure costs are charged to each partner program based on proportionate use and relative benefit received;(ii) Federal cost principles; and(iii) Any local administrative cost requirements within the federal VR grant.(4) The department must enter into an MOU with the local workforce development boards relating to the operation of the one-stop delivery system to include elements described in 34 C.F.R. 361.500 and 361.755.Wash.
