Section 392-172A-05065 - Qualifications and selection of mediators(1) Mediation shall be conducted by qualified and impartial mediators who are knowledgeable in laws and regulations relating to the provision of special education and related services.(2) An individual who serves as a mediator: (a) May not be an employee of any school district or other public or private agency that is providing education or related services to a student who is the subject of the mediation process; and(b) Shall not have a personal or professional conflict of interest; and(c) A person who otherwise qualifies as a mediator is not an employee of a school district or other public agency solely because he or she is paid by the agency to serve as a mediator.(3)(a) The OSPI, through its contracted administrative agents, shall maintain a list of individuals who are qualified mediators and knowledgeable in laws and regulations relating to the provision of special education and related services.(b) Mediators will be selected on a random, rotational or other impartial basis.Wash.
