Section 388-835-0130 - What rights are available to a resident regarding a proposed transfer?(1) A resident, their guardian, next-of-kin, or responsible party must be notified in writing at least thirty days before any transfer occurs.(2) The transfer notice must include: (a) The reasons supporting the proposed transfer;(b) A statement that the resident or any other individual designated by the resident has a right to a conference with a DDA representative within twenty-eight days of receipt of the notice;(c) A statement that the resident has the right to request a hearing to contest the department's decision within thirty days of the notice;(d) Information as to how a hearing can be requested;(e) A statement that the resident has the right to be represented at the hearing by an authorized representative; and(f) Information regarding the availability and location of legal services within the resident's community.Wash.
