Section 28 010 001 - BURGLAR ALARM, ASSESSEMENT OF FEES FOR: 1) TERMINATION OF ALARMS AT STATE POLICE FACILITY, 2) RESPONSE TO FALSE ALARMS

STATE OF VERMONT DEPARTMENT OF PUBLIC SAFETY DIVISION OF STATE POLICE

ADOPTED RULE: Burglar Alarm, Assessment of fees for:

1) Termination of Alarms at State Police Facility
2) Response to False Alarms.

STATUTORY AUTHORITY:

SECTION 83 OF NUMBER 245 OF THE ACTS OF THE 1992 LEGISLATURE

The text of the adopted rule as provided below is being forwarded as required by the Administrative Procedures Act. It is also intended as our method of informing you of this Department's fee structure concerning:

1) termination of alarms at State Police Barracks, and
2) response to alarm sites by the Vermont State Police and it is determined that the alarm is false.

Termination Fees:

The termination fee for a single, dedicated circuit alarm at a State Police facility will be $ 250 per user per year, or;

An alarm company or monitoring service that is authorized to install a multi-unit alarm panel at a State Police facility will be assessed a fee of $ 25.00 per alarm, with a minimum fee of $ 250 per panel per year, or;

Tape dialers: An individual or business who programs a tape dialer to transmit a voice message to a State Police Facility, informing the police of a burglary or other emergency, must register such dialer with the State Police and will be assessed a registration fee of $ 50.00 per year. This fee includes an on site inspection by a member of the State Police.

Note: When the State Police are called to the scene of an alarm and it is found that the alarm was transmitted by a tape dialer which has not been registered, the registration fee of $ 50 will be assessed at that time.

False Alarms:

For the purposes of assessing a fee, a false alarm is defined as the notification given to the State Police by electronic or telephonic means that an emergency situation exists, when an emergency or other circumstances that could be perceived as an emergency does not exist, and for which the State Police have responded.

The fee assessed for a false alarm, received at a State Police facility, either electronically or telephonically, will be $ 50 for the first false alarm beyond the number of false alarms allowed, and $ 75 for each subsequent false alarm.

Note: One (1) false alarm in a twelve (12) month period will be allowed without charge.

The fees for false alarms will be billed by the Accounting Department of the Department of Public Safety. The accounting department will also notify the station commander of any assessment for a false alarm that has not been paid.

Response Terminations:

Upon receipt of notification by the accounting Department that fees assessed for false alarms have not been paid, or there exists a history of repeated false alarms, and the alarm holder has not made a good faith effort to correct the problem, the Station Commander with the concurrence of the Troop Commander may notify the alarm holder that troopers will no longer respond to an alarm at that location until such time as the fees have been paid or the problem has been corrected.

Appeals:

An alarm holder may appeal the decision of a Station Commander to the Troop Commander.
