Section 12 020 001 - REGULATIONS FOR OPERATING CHIP HARVESTERS IN VERMONTPursuant to the authority of 10 V.S.A., § 2623, the following regulations are adopted by the Department of Forests, Parks and Recreation:
1. All portable chip harvesters operated in Vermont shall be registered and licensed by the Department of Forests, Parks and Recreation.2. "Chip harvester" is defined as any type of portable, mechanized equipment designed and operated for the purpose of processing whole trees, or parts of trees, by passing the trees through the machine to produce wood chips. Specifically excluded are small, portable brush chippers used for landscaping, right-of-way clearing, and similar non-industrial forest products activity.3. "License" is defined as a form developed by the Department of Forests, Parks and Recreation, and made available to an owner or operator/agent of a chip harvester.4. The owner, or responsible operator/agent of a licensed chip harvester, upon request from the Department of Forests, Parks and Recreation, shall provide information with respect to the location and duration of chip harvester operations.5. The State of Vermont, as represented by officials and employees or agents of appropriate agencies, shall have the authority to inspect and monitor chip harvester operations, including the woodland operations which support this particular machine, as to compliance with these regulations; and to obtain such technical data and information as may be necessary and useful for forest management and environmental conservation purposes.
