Section R590-206-4 - Rules of Construction(1)(a) The examples in this rule, the sample clauses in Appendix A, and the Federal Model Privacy Form in Appendix B are not exclusive.(b) Appendix A, "Privacy of Consumer Financial and Health Information Regulation," and Appendix B, "Privacy of Consumer Financial and Health Information Regulation," adopted April 11, 2017, by the NAIC shall be used to comply with this rule, and are available on the department's website, https://insurance.utah.gov.(c) Compliance with an example or use of a sample clause, to the extent applicable, constitutes compliance with this rule.(d) A licensee domiciled in this state that complies with this rule in a state that has not enacted laws or rules that meet the requirements of Title V of the Gramm-Leach-Bliley Act (PL 102-106) is compliant with Title V of the Gramm-Leach-Bliley Act in the other state.(2)(a) A licensee may rely on use of the Federal Privacy Form in Appendix B, consistent with the form's instructions, as a safe harbor of compliance with the privacy notice content requirements of this rule.(b) A licensee may continue to use a privacy notice, including a notice that contains the examples in this rule, provided that the notice accurately describes the licensee's privacy practices and complies with this rule.(3) A licensee may not rely on a privacy notice with the sample clauses in Appendix A as a safe harbor of compliance with the notice content requirements of this rule.Utah Admin.
