Section R512-100-2 - Definitions(1) "Child and Family Plan" is defined in Section 80-1-102.(2) "Child and Family Services" means the Division of Child and Family Services.(3) "Child and Family Team" is the family's identified informal supports and the service providers working with the family. (4) "Kinship Caregiver" includes relatives as defined in Section 80-3-102, and includes individuals that are unrelated by either birth or marriage but have an emotionally significant relationship with the child that takes on the characteristics of a family relationship.(a) For Indian children, the definition of extended family member under the Indian Child Welfare Act, 25 U.S.C. Section 1903, applies, which includes an extended family member as defined by the law or custom of the Indian child's tribe; in the absence of such a law or custom, a person who has reached the age of 18 and who is the Indian child's grandparent, aunt or uncle, brother or sister, brother-in-law or sister-in-law, niece or nephew, first or second stepparent; or an Indian custodian as defined by the Indian Child Welfare Act case law.(b) Children who are under the placement and care responsibility of the state are, by definition, in foster care and are not prevention candidates when placed with a kinship caregiver.(5) "Prevention Candidate" is a child under age 18 when at serious risk of entering or reentering foster care, but able to remain safely in the home or kinship placement as long as mental health, substance use disorder, or in-home parent skill-based programs or services for the child, parent, or kinship caregiver are provided. A child may be at serious risk of entering foster care based on circumstances and characteristics of the family as a whole or circumstances and characteristics of individual parents, children, or kinship caregiver that may affect the parents' ability to safely care for and nurture their children.(6) "Utah Family and Children Engagement Tool (UFACET)" is an assessment tool used to identify child and family needs and guide addressing those needs with services in the child and family plan.Utah Admin.
