Section R410-14-18 - Declaratory Orders(1) DIH may issue declaratory orders in accordance with Rule R380-1.(2) If DIH does not issue a declaratory order within 60 days after receipt of the request, the petition is denied.(3) DIH shall retain the request for declaratory ruling in its records.(4) DIH may not issue a declaratory order if an adjudicative proceeding that involves the same parties and issue is pending before the agency, federal court, or state court.Utah Admin.
