Section R383-15-4 - Availability of Hearing(1) When the Board recommends denial of a petition pursuant to Subsection 26B-1-421(5), the petitioner may request a hearing within 15 calendar days of receipt of the notice of agency action.(2) A party who fails to request a hearing within 15 calendar days of receipt of the notice of agency action shall have no right to an administrative hearing or judicial review of the agency action, unless the party can demonstrate, by a preponderance of the evidence, that it was virtually impossible or unreasonably burdensome to file the request within 15 calendar days.Utah Admin.
