Section R380-42-3 - Procedures(1) A public body, as defined in Subsection 52-4-103(10), may hold an open and public meeting where members of the public body or the general public participate electronically or telephonically.(2) When an electronic meeting is scheduled, the public notice required by Section 52-4-202 shall describe: (a) the electronic or telephonic method by which members of the public body or the general public may participate; and(b) the anchor location where members of the public body or the general public may attend, monitor, and participate in the open portions of the meeting, unless the public body is permitted under Subsection 52-4-207(5) to hold the electronic meeting without an anchor location.(3)(a) The anchor location is the physical location from which the electronic meeting originates or from which the participants are connected.(b) The anchor location shall have sufficient space and facilities so that interested persons and the public may attend, monitor, and participate in the open portions of the meeting.(4) At the commencement of the meeting the chair shall identify for the record all those who are appearing telephonically or electronically.(5) The public body shall count a member who appears electronically or telephonically as present for purposes of determining a quorum.(6)(a) A member who appears electronically or telephonically may fully participate and vote on any matter before the public body.(b) The chair shall confirm votes by members who are appearing electronically or telephonically.Utah Admin.
