Section R315-319-50 - Scope and Applicability(a) Rule R315-319 establishes criteria for purposes managing coal combustion residuals in Utah.(b) Rule R315-319 applies, except as provided in Subsection R315-319-50(i), to owners and operators of new and existing CCR units as defined in Subsection R315-319-53(a)(15). Rule R315-319 applies to any practice that does not meet the definition of a beneficial use of coal combustion residuals.(c) Rule R315-319 applies to inactive CCR surface impoundments that have not closed prior to the effective date of Rule R315-319.(d) Rule R315-319 does not apply to coal combustion residual landfills that have ceased receiving coal combustion residuals prior to October 19, 2015.(e) Rule R315-319 does not apply to electric utilities or independent power producers that have ceased producing electricity prior to October 19, 2015.(f) Rule R315-319 does not apply to fly ash, bottom ash, boiler slag, and flue gas desulfurization materials, generated primarily from the combustion of fuels, including other fossil fuels, other than coal. Disposal of these solid wastes are covered by Rules R315-301 through 307.(g) Rule R315-319 does not apply to practices that meet the definition of a beneficial use of coal combustion residuals.(h) Rule R315-319 does not apply to coal combustion residual placement at active or abandoned underground or surface coal mines.(i) Rule R315-319 does not apply to Class I or V solid waste landfills that receive coal combustion residuals.Utah Admin.
