Section R315-310-2 - Procedures for Permits
(1) Prospective applicants may request the director to schedule a pre-application conference to discuss the proposed solid waste facility and application contents before the application is filed.
(2) Any owner or operator who intends to operate a facility subject to the permit requirements shall apply for a permit with the director.
(3) Applications for a permit shall be completed in the format prescribed by the director.
(4) An application for a permit, any reports required by a permit, and other information requested by the director shall be signed as follows:
(a) for a corporation: by a principal executive officer of at least the level of vice president;
(b) for a partnership or sole proprietorship: by a general partner or the proprietor;
(c) for a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official; or
(d) by an authorized representative of the person specified in Subsections R315-310-2(4)(a) through R315-310-2(4)(c), as appropriate.
(i) A person is an authorized representative only if the authorization is made in writing, to the director, by a person described in Subsection R315-310-2(4)(a), R315-310-2(4)(b), or R315-310-2(4)(c), as appropriate.
(ii) The authorization may specify either a named individual or a position having responsibility for the overall operation of the regulated facility or activity, such as the position of facility manager, director, superintendent, or other position of equivalent responsibility.
(iii) If an authorization is no longer accurate and needs to be changed because a different individual or position has responsibility for the overall operation of the facility, a new authorization that meets the requirements of Subsections R315-310-2(4)(d)(i) and R315-310-2(4)(d)(ii) shall be submitted to the director before or together with any report, information, or application to be signed by the authorized representative.
(5) Filing Fee and Permit Review Fee.
(a) A filing fee, as required by the Annual Appropriations Act, shall accompany the filing of an application for a permit. The review of the application will not begin until the filing fee is received.
(b) A review fee, as established by the Annual Appropriations Act, shall be charged at an hourly rate for the review of an application. The review fee shall be billed quarterly and shall be due and payable quarterly.
(6) Any content and material submitted as a permit application shall become part of the approved permit and shall be part of the operating record of the solid waste disposal facility.
(7) The owner or operator, or both, of a facility shall apply for renewal of the facility's permit every ten years.
