Section R58-17-11 - Statement of VariancesCircumstances may arise that cannot be adequately addressed or resolved with this rule. The Board may grant specific variances to the rule if the following conditions are met:
(1) the variance is based on scientifically sound information and rationale;(2) the variance will cause no significant threat to other public or private aquaculture operations, or to public fishery resources; or(3) the variance is approved by majority vote of a quorum of the Board.Utah Admin.
