(a) This subchapter prescribes the policies and procedures governing bidder qualification, bidding, award, and execution of a contract entered under Transportation Code, Chapter 223, Subchapters A-C.(b) As an alternative to using Transportation Code, Chapter 223, Subchapters A-C, and therefore, this subchapter, the department, if the department satisfies the requirements of Transportation Code, § 223.001(c), may award under the State Purchasing and General Services Act, Subtitle D, Title 10, Government Code, a contract for certain materials to be used in the construction or maintenance of a highway or for traffic control or safety devices to be used on a highway as a purchase of goods.43 Tex.
