Section 21.311 - General Requirements(a) The department may not convey title to, or sever from the real property, a permanent improvement constructed on the property leased under this subchapter.(b) Outdoor advertising will not be permitted under an agreement under this subchapter.(c) The person who enters into an agreement with the department under this subchapter is responsible for any common carrier obligation associated with the facility developed under the agreement.(d) A person's use of right of way under an agreement under this subchapter does not constitute abandonment of the property by the department.43 Tex.
